WHAT ARE COOKIES?

2.1. Visiting the website

We are responsible for processing the data collected on our website. As we work with the partners listed below, we ensure that the platforms on which we store data are in compliance with data protection regulations. However, each of our partners has its own privacy policy, as outlined below.

Our website is hosted on the www.wix.com platform. Your data can be stored via the data store, databases and general applications of www.wix.com, on secure servers behind a firewall. Wix.com is an Israeli company, Israel appears to be one of the states for which adequate data protection is guaranteed as stated in Annex 1 of the Data Protection Ordinance (OPDa). Our Service may contain links to third-party websites. Access to and use of such linked websites are not subject to this Privacy Policy, but are subject to the privacy policies of such third party websites. We are not responsible for the information practices of such third-party websites.

When you visit our websites, our servers temporarily store each access in a log file:

  • IP address of the requesting computer (abbreviated);

  • name of the access provider (usually the Internet access provider);

  • date and time of access;

  • name and URL of the retrieved file;

  • page and address of the Web site from which you are being redirected to our sites

    and, if applicable, the search term used;

  • Country from which access to our websites takes place;

  • computer operating system and browser used (provider, version and language);

  • transmission protocol used (e.g., HTTP/1.1).

    The collection and processing of the above-mentioned data is carried out to enable the use of our websites (connection establishment), to ensure the security and stability of the system on a permanent basis, to optimize our Internet offering as well as for internal statistical purposes.

    Only in the event of an attack on the network infrastructure or if other abusive or unauthorized use of the website is suspected, the IP address will be analyzed for the purposes of clarification, defense and, where appropriate, identification in criminal proceedings and to take civil or criminal action against the users concerned

  • Finally, cookies and other cookie-based applications are used during visits to our websites. More information on this can be found in the chapters “Cookies” and “Tracking Tools.”

 

2.2. Using the Nexudus / Passport App.


The following data are processed during the use of our services in the Nexudus / Passport

App:

  • last name; first name;

  • address;

  • phone number;

  • e-mail address;

The processing of the above data is necessary in order to provide Impact Hub Ticino's services, including, for example, managing membership plans, room-booking, and billing for regular and extra services. If this information is not provided, the use of Impact Hub Ticino's services and spaces will not be possible.

Nexudus software is operated by Nexudus and is based at Unit 205, 1-3 Brixton Road Chester, London SW9 6DE, UK. Nexudus protects customer data from unauthorized access, use, or publication. All data transmissions are protected by “Secure Socket Layer (SSL)” encryption. More information about data protection at Nexudus can be found at: https://learn.nexudus.com/platform/gdpr-and-nexudus The data you enter will be used by us exclusively for contract performance, fulfillment of our contractual and pre-contractual obligations, or, if applicable, for direct advertising.

The data are deleted as soon as they are no longer necessary for the provision of services. Excluded from deletion are data that by law must be kept longer, for example, contractual data. The obligations that require us to retain data are prescribed by the rules of tax and accounting law, according to which business communications, concluded contracts and accounting records must be retained for up to 10 years.

2.3. Newsletter

 

Every member and participant in Impact Hub Ticino events is automatically subscribed to our Newsletter. The following personal data are collected as part of this activity:

  • first name;

  • Last name;

  • e-mail address

The sending of the newsletter is done through the email marketing service provider “Mailchimp”, a newsletter sending platform offered by the US company Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA. The data protection provisions of the email marketing service provider can be found here. Rocket Science Group LLC d/b/a Mailchimp is also certified under the “Privacy Shield” agreement and thus offers a guarantee regarding compliance with European data protection standards (PrivacyShield). We use the services of the email marketing service provider on the basis of our legitimate interests in accordance with Art. 6 para. 1 lit. f GDPR and a contract of appointment as a data controller in accordance with Art. 28 para. 3 sentence 1 GDPR.

The email marketing service provider may use recipients' data under pseudonyms, i.e., without being able to associate them with specific users, in order to optimize or improve its services, e.g., for optimizations at the technical level of the emailing service and newsletter display or for statistical purposes. However, the email marketing service provider does not use the data of our newsletter recipients to send its own emails or to pass such data on to third parties.

You can unsubscribe from the newsletter at any time by contacting us directly or via the corresponding link at the bottom of the newsletter or other communication.

 

Personal data processed for sending the newsletter via email are deleted when you unsubscribe.

2.4. Whatsapp Group

 

You can join Impact Hub Ticino's messaging group through the instant messaging service WhatsApp. WhatsApp is a service of WhatsApp Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland, a subsidiary of WhatsApp Inc, 1601 Willow Road, Menlo Park, California 94025, USA, both referred to below as “WhatsApp”. The processing of user data may sometimes take place on WhatsApp's servers in the USA.

 

However, due to its certification under the EU-US data protection agreement, “EU-US Privacy Shield,” WhatsApp ensures that it also follows the EU data protection requirements when processing data in the US. In addition, WhatsApp offers additional privacy-related information.

2.5. Event registrations

 

Impact Hub Ticino organizes various events for hubbers and the general public. As part of these activities, the following personal data are collected:

  • first name;

  • last name;

  • e-mail address.

​We regularly use third-party platforms to manage event registrations and attendance (WIX.Com).

2.5.1. Photographs during events

 

During our events, we may take photographs in which contributors and participants may be present. These photographs are often used for promotional purposes, including publications on our web platforms and social media channels.

 

 

2.5.2. Anonymity and recognition

 

Although we do not publish the names of people who appear in these photographs, please keep in mind that people may still be recognizable. Our goal is to capture the spirit and activities of our events without compromising personal privacy.

 

 

2.5.3. Requests for opt-out and removal

 

We respect the privacy preferences of our staff and event participants. If you do not wish to be photographed, please inform us before or during the event. Also, if you find a photograph of yourself on any of our platforms that you would like removed, you may request its removal by contacting us at ticino@impacthub.net. We are committed to fulfilling such requests in a timely manner to ensure that privacy is respected.

2.6. Applications

If you send us your application for open positions and spontaneous applications, we process the following personal data for verification purposes:

  • Last name, first name;

  • address;

  • date of birth;

  • telephone number;

  • gender;

  • nationality;

  • resume information;

  • other data you provide as part of the application process.

Personal data processed are deleted no later than six months after the completion of the application process.

2.7 External payment service providers

Our website uses external payment service providers, on whose platforms payment transactions can be made between us and users. For example through:

As part of the fulfillment of contracts we use, if and to the extent necessary, payment service providers within the meaning of the Swiss Data Protection Regulation, Art. 6 para. 1 lit. b of the EU GDPR. We also use, if and to the extent necessary, external payment service providers on the basis of our legitimate interests within the meaning of the Swiss Data Protection Regulation, Art. 6 para. 1 lit. f of the EU RGPD, in order to offer our users efficient and secure forms of payment.

The data processed by payment service providers include, among others, constituent data such as name and address, bank data such as account or credit card numbers, passwords, TANs and check sums as well as contract, total and recipient-related data. This data is necessary to carry out transactions. In any case, the data entered are processed only by the payment service provider and stored only with him. As handlers we do not receive any (bank) account or credit card information, but only information indicating confirmation (acceptance) or rejection of payment. Sometimes data are transmitted by the payment service provider to firms that specialize in searching for specific information about companies. This is for the purpose of identity and creditworthiness verification. In this regard, please refer to the payment service provider's general terms and conditions and its privacy notices.

For payment transactions, the terms and conditions of sale of the payment service provider in question as well as its privacy notices, which can be found on its website or in transaction applications, apply. Please also refer to the same sources for more information and to enforce the rights of the data subject, the right of withdrawal and the right to information.

2.8 Other External Service Providers

Impact Hub Ticino and any external service providers (listed below) who will process or access your personal data will do so primarily from Switzerland or the EEA. In the event that data is processed outside Switzerland or the EEA and in accordance with the DPA, OPDo and EU Regulation 2018/1725, Impact Hub Ticino will previously ensure an adequate level of protection of individuals' fundamental right to data protection, in particular by adopting the European Commission's Standard Contractual Clauses.

List of external service providers:

Data will be kept for as long as necessary to fulfill the purposes for which it was collected and for up to 2 years after the last contact, unless the law requires us to keep it for a longer period. Thereafter they will be destroyed or anonymized.

 

3. From which sources do we collect personal data?

We collect personal information directly from you, such as when you register for events or programs organized by us, or through your enrollment in a membership plan and through your visits to our social and website.

4. Where do we store your personal data?

Personal data are stored on secure servers located in Switzerland and the European Union. These servers fulfill the relevant provisions defined by the Swiss legislature (see Chapter 1, foreword above).

5. How long do we process personal data?

We process personal data for as long as required by our processing purposes, statutory retention periods, and our legitimate processing interests for documentary and evidentiary purposes or where retention is necessary for technical reasons. More information on retention and processing periods can be found for individual data categories in paragraph 2 and for cookie categories in paragraph 10. Unless there are legal or contractual obligations to the contrary, we will delete or anonymize personal data at the end of the retention or processing period.

Documentary and evidentiary purposes include, in particular, our interest in documenting processes, interactions, and other circumstances in the case of legal actions and discrepancies, IT and infrastructure security purposes, and substantiation of compliance with internal Corporate Governance and Compliance regulations. Retention may be technically necessary if some data cannot be separated from others and therefore subject to joint storage (e.g., in the case of backups or document management systems).

6. To whom do we disclose personal data?

In connection with the use of the Nexudus App and website or as part of the application process, we transmit personal data to the following categories of recipients:

  • Authorities: we may transmit personal data to offices, courts and other authorities or regulatory bodies in Switzerland and abroad, if this is permitted or required by a legal obligation or necessary to protect our interests. The processing of personal data transmitted to such authorities takes place under their responsibility.

7. Transfer of personal data abroad

personal data about you is also disclosed to third parties, not only in Switzerland. Therefore, the processing of personal data may also take place in Europe and the United States (e.g., if Google Analytics is used) or, in exceptional cases, in any country in the world.

Some of the third-party service providers mentioned in this notice are based in the United States. For the sake of completeness, it should be mentioned that control measures of the U.S. authorities are in place in the United States that generally allow the retention of all personal data transferred to the United States from Switzerland or the EU. This is done without any differentiation, limitation, or exception on the basis of the purpose pursued, and without any objective criteria to limit the U.S. authorities' access to, and subsequent use of, the data to specific and strictly limited purposes that could justify the intervention associated with both access and use of such data. There are also no legal remedies available in the United States for Swiss data subjects to obtain access to and rectification or deletion of their data, and there is no effective legal protection against the general access power of the U.S. authorities. We expressly emphasize this legal situation to enable you to make a properly informed decision when providing consent to the use of your personal data.

 

It should also be remembered that data exchanged via the Internet are often redirected through third countries. Your data may therefore be transferred abroad even if the sender and recipient are in the same country.

8. Do we use tracking techniques and online advertising?

On our website, we use Google Analytics , an analytics tool from Google Inc. 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, and Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (Google), which makes use of tools, such as cookies, that enable analysis of visits to our websites. Data related to website usage collected through cookies, such as.

  • App updates,

  • browser information,

  • click history,

  • date and time of visit,

  • device information,

  • downloads,

  • Flash version,

  • approximate geolocation data (country and city),

  • IP address,

  • JavaScript support,

  • pages visited,

  • purchases made,

  • referrer URL,

  • usage data,

  • widget interactions,

  • user's navigation path through websites,

  • time spent on websites and subpages,

  • subpage from which the user left the websites,

  • Country, region or city from which the access was made,

  • end device (type, version, color depth, resolution, browser window width and height),

  • recurring or new visitor,

  • browser provider/version,

  • operating system used,

  • referrer URL (website already visited),

  • hostname of the accessing computer (IP address),

  • time of the server request,

are normally transferred to a Google server in the United States, where they are stored. Prior to transfer within the member states of the European Union as well as in other signatory states of the Agreement on the European Economic Area and Switzerland, the IP address is shortened by Google by activating IP anonymization (“anonymizeIP”). According to Google, the masked IP address that is transferred as part of the Google Analytics service is not associated with any other data stored by Google. Only in exceptional cases, the full IP address is first transmitted to a Google server in the USA and then shortened there. In these cases, the user's consent to data processing is previously requested.

 

The information is used to analyze the use of our website, compile reports on activities thereon, and provide other services related to such use for market research purposes. This information is possibly passed on to third parties, provided this is required by law or to the extent that they are entrusted with data processing.

 

Users can prevent the recording of data generated by cookies and related to the use of the website (incl. IP address) as well as the processing of such data by Google by preventing the use of cookies or by making the appropriate settings on the website (see section 10 in this regard).

9. Cookie

Cookies contribute in many ways to making your visit to our websites easier, more enjoyable, and more meaningful.

Cookies are individual codes (e.g., a serial number) that are transmitted from our server or that of our service providers or advertising partners to the user's system (browser, cell phone) when they log on to our website. The user's system accepts them and stores them until the scheduled expiration time, and at each subsequent access it retransmits them to our server or the server of a third party. In this way, the user is recognized even if his/her identity is not known.

Whenever the user accesses a server (e.g., to visit a website or use an app, or because a visible or non-visible image is embedded in an e-mail), these visits can then be “tracked” (followed).

 

Most Internet devices/browsers automatically accept cookies. A distinction is made between the following cookies:

  • Necessary cookies: some cookies are necessary for the websites to function as such or for certain functions. For example, they ensure the ability to move from one page to another without losing the information entered in a form. They also allow the user to stay logged in to the site without having to re-enter credentials. These are temporary cookies (“Session Cookies”). If they are blocked, the website may not work. Other cookies are necessary to enable the server to store decisions or entries made by the user beyond the session (i.e., use of the website), if the user has selected that function (e.g., language selected, consent provided, automatic login function, etc.). These cookies are stored for a period of up to 12 months.

  • Performance cookies: to optimize our website, we use cookies to record and analyze site usage, possibly beyond the session. We do this by using the analytics services of third-party vendors, which are listed below. Before using these cookies, we ask you to accept them. 10. What data do we process on our pages in social networks?

On our websites there are links to our social media. The respective buttons only provide a link to our presence on those networks. No user data is transmitted from Impact Hub Ticino to the social network.

When a link to one of our social profiles is invoked, a direct connection is established between the user's end device and the server of the social network in question, to which information is thus transmitted that the user has visited our website and invoked the link. If the user makes use of the link after logging in to his or her account on that network, the contents of our website may be associated with the user's social profile; in other words, the network may assign the use of our website directly to the user's account. To prevent this from happening, it is necessary to log out before clicking on the corresponding links. Assignment occurs in any case if the user accesses the network in question after clicking on the link.

11. How do we protect personal data?

We take appropriate technical and organizational security measures to protect collected personal data from manipulation, total or partial loss, and access by unauthorized third parties. Our security measures are constantly improved in step with technological development.

We also take internal data protection within the company very seriously. Our employees and service providers are contractually bound to comply with confidentiality and data protection regulations.

12. What are your rights?

Right to information: You have the right to request access to your personal data stored by us at any time and free of charge when we are processing it. This gives you the opportunity to check what personal data pertaining to you we are processing and to ensure that we are using it in accordance with applicable data protection regulations.

Right to rectification: You have the right to have incorrect or incomplete personal data rectified and to be notified of the rectification. In this case, we will inform the recipients of the data concerned of the amendments made, unless this is impossible or involves disproportionate effort.

Right to erasure: You have the right to have your personal data deleted under certain circumstances. In individual cases, the right to erasure may be excluded.

Right of revocation: If data processing is based on consent, you have the right to revoke your consent at any time with effect for the future. Processing activities performed in the past based on your consent do not become unlawful as a result of your revocation.

 

Revocation of consent may result in the discontinuation of the TWINT service.
